This law prohibits a physician from referring a a patient to an immediate family member. What happens if there are 2 brothers who are both physicians, operating out of the same building and on the deathbed of one of the brothers, he says he wants all of his patients to be transferred over to his brother.
Would there be a violation of the Stark Law? It seems that there wouldn't be since these patients need a doctor anyway and the one they always saw is now deceased. I can find all kinds of information about the illegality of referring to an immediate family member but nothing on this situation.

The brother who is dying wishes to have his brother take over the care of his patients.  There is nothing wrong with this.  It should not be a violation of Stark.  It would be no different than one brother leaving and forming a practice in another part of the country and having the other brother take over the care of the patients.
