Does a patient who hasn't been seen in the last 3 years HAVE to be coded as a new patient or can an established patient code be used if the reimbursement would be higher for the established patient E&M level?

Per CPT. a new patient is one who has not received any professional services from the physician or another physician of the same specialty who belongs to the same group practice, within the past three years.
