We have conflicting information regarding Medicaid within our office.  We do not take some Medicaid HMO's.  If the patient has Medicare and Medicaid HMO that we do not take as a secondary I was told we can not bill them.  We have been turning these patients away.  My co-worker says that if we have them sign a disclosure form in advance that makes them aware that they are responsible for the 20% we can bill them.     When I questioned NJ Medicaid years back they told me we could not because when they have Medicaid they have it because they can't afford to pay out of pocket.   Does anyone in NJ know the right answer?

When your patient has a secondary not contracted, you can bill the patient for the balance owed.  

NJAC, Title 11 says you can
